Council approves settlement with resident hit by city employee’s car. see how much

On Tuesday, the Jackson City Council approved another settlement involving a resident who was in a vehicle accident with a city employee.

The council approved a $15,000 settlement for Kenneth McClure. On Dec. 19, 2018, McClure was attempting to turn east onto Hoover Street when his car was struck on the left passenger side by a vehicle operated by Jackson employee Daniel Moore, according to court documents. The impact of the accident was “so forceful and violent that it caused serious damage” to McClure and his car.

McClure sued the city in 2020, seeking compensation for financial and property damages and medical expenses. McClure, through his attorney Patrick Wooten, requested a $75,000 settlement.

Wooten did not respond to a request for comment. The Jackson City Attorney’s Office also said they could not provide any further details about the case at this time.

Six council members voted to approve the agreement, while District 3 Councilman Kenneth Stokes abstained.

The Clarion Ledger reported in March that Jackson faces at least 24 demands because city employees were involved in vehicle accidents with city-owned vehicles. The investigation was the second part of an occasional series looking at the lawsuits facing Jackson, which the Clarion Ledger received after filing a public records request.

Of the 24 vehicular lawsuits, 17 involve municipal employees from various departments. Five of the lawsuits involve Jackson Police Department officers crashing police vehicles into citizen cars; two involve firefighters from the Jackson Fire Department crashing fire trucks into citizens’ cars.

With the McClure settlement, the city has reduced the number of lawsuits involving city employees involved in vehicle accidents from 24 to 22. In June, the council unanimously approved a $160,000 settlement for the wrongful death of Stevie Fuller, a pedestrian who was struck by a city employee’s vehicle in May 2017.

Fuller, a Jackson resident, was walking near the Gateway Rescue Mission shelter on Gallatin Street. While Fuller was walking, he was “struck by a motor vehicle owned by the city of Jackson, Mississippi and operated” by a city employee, the lawsuit states. Fuller died at the scene of the accident from his injuries.

City attorneys reached a settlement with Fuller’s brother and sister, Roger and Linda Fuller.
