Bill Barr: Prosecutors should ‘do the right thing’ and dismiss Trump cases: ‘Respect the people’s decision’

Former Attorney General Bill Barr, who served in President-elect Donald Trump first administration, is asking prosecutors at the state and federal level to dismiss pending legal cases against Trump before he takes office again.

Barr told Fox News Digital that voters were very aware of all the accusations against Trump when elect him for a second term in office on Tuesday, and that it is best for the country for prosecutors to listen to them.

“The American people have delivered their verdict on President Trump and decisively elected him to lead the country for the next four years,” Barr said. “They did so with full knowledge of the allegations against them by prosecutors across the country, and I believe Attorney General Garland and state prosecutors should respect the people’s decision and dismiss the cases against President Trump now.”

Barr stated that the legal theories in some of the cases had already been “greatly weakened by a series of court decisions” and that the issues “have now been widely aired and rejected by the American people.”

Once Trump takes office in January, Barr noted, prosecutors will not be able to pursue cases during his term. A Trump-appointed attorney general may end federal cases brought by special counsel Jack Smith, one in Wasdhington, D.C., for alleged efforts to overturn the result of the 2020 election, and another in Florida based on allegations related to the retention of classified documents after their first term.

The Florida case was dismissed by US District Judge Aileen Cannon on technical grounds related to Smith’s appointment, and the Washington case was undermined by a US Supreme Court ruling that ruled that presidents have immunity from prosecution for certain official actions.

“We have immunity in the Supreme Court,” Trump told Hugh Hewitt last month. “It’s very easy. I’d fire (Smith) in two seconds. He’ll be one of the first people on board.”

But Trump would be powerless to stop state cases brought against him in New York and Georgia. One of them is a pending state criminal case in Georgia based on alleged efforts to overturn that state’s results in the 2020 election. He has also been convicted in a criminal case in New York for falsifying business records related to a money payment made to adult film actress Stormy Daniels before the 2016 election, and has a sentencing hearing scheduled for later this month.

Barr said local prosecutors and judges must put the spectacle of prosecuting the future sitting president behind them.

“Further maneuvering in these cases in the coming weeks would serve no legitimate purpose and would only distract the country and the incoming administration from the task at hand,” he said.

“The public interest now demands that the country come together and focus on the challenges we face at home and abroad. Attorney General Garland and all state prosecutors must do the right thing and help the country move forward by dismissing the cases,” he added .

This includes the New York criminal case in which Trump has already been found guilty, but has not yet received a sentence. Barr asked state prosecutors to dismiss the case, even though he already obtained a conviction.

“That case is riddled with abuses and legal errors,” Barr said. “If the litigation continued, it would eventually be thrown out, but we shouldn’t tolerate that kind of distraction. And I think the right thing to do would be for prosecutors to dismiss the case.”

When asked if this is likely to happen, Barr’s response was blunt.

“We’ll see what they think of democracy.”
