Lyon County addresses redistricting discrepancy

LYON COUNTY, Nevada (KOLO) – Update at 3:52 pm: Lyon County issued a statement Monday afternoon addressing a district issue raised by Nevada Secretary of State Cisco Aguilar.

The county says they were made aware of the issue on Nov. 1, calling it an issue involving placing a portion of Lyon County’s 26th Precinct in an incorrect Assembly District. After a review, that portion of Precinct 26 was not redistricted as anticipated by the passage of SB1, but instead remained in Assembly District 38 when it should have been moved to Assembly District 39.

Lyon County says they and the Secretary of State’s Office have concluded that no significant changes can be made before the close of the election.

The problem lies with a portion of Lyon County’s 26th Precinct, which was not properly redistricted after the 2021 Special Legislative Session.

He remained in the 38th Assembly District when he should have moved to the 39th Assembly District. However, in a statement, Aguilar says that because the issue was discovered in the middle of the General Election, there is no way to make the change before Tuesday.

The candidates have been informed of the discrepancy.

Under state law, any race for the state Legislature goes to the Legislature for review.

“This afternoon, the Lyon County Clerk/Treasurer informed the Secretary of State’s Office that a precinct may have been placed in the incorrect Assembly District. Upon further review and investigation, it became clear that a portion of Lyon County’s 26th Precinct was not appropriately redistricted following the 2021 Special Legislative Session, and remained in Assembly District 38 when it should have been moved to Assembly District 39. the Assembly, as indicated by the passage of Senate Bill 1 of the 33rd Special Session. In total, three Assembly District candidates are on the 2024 General Election ballot for the 38th and 39th Assembly Districts. As we were informed of this during the conduct of the general election, there is no meaningful way to make any changes before the election closes.

NRS 293.425 and 293.427 govern races for state legislative seats and make clear that any race goes to the Legislature for review. “The Lyon County Clerk’s Office informed the candidates this afternoon of the improper redistricting.”
