Portland Incinerator: How is a planning decision challenged?

Ricardo Gama, an environmental lawyer at Leigh Day – the law firm representing the activists – said the SPWI group “believes that Powerfuel Portland has submitted a speculative plan in the completely wrong place, contrary to planning policy”.

The group said the Secretary of State’s decision “does not satisfy” Dorset Council’s Waste Plan, which designates specific waste disposal sites closest to major waste-generating settlements in the county.

Debbie Tulett, who brought the legal challenge, said: “It is devastating and frustrating to see the Government’s view that the incinerator would not harm the iconic landscape of the Isle of Portland.

“While it is difficult to legally challenge this aspect of their decision, we can criticize the government for its neglect of planning policy.”
