District Attorney George Gascón’s meddling in the Menéndez brothers’ case criticized as a trick

The decision of ultra-liberal Los Angeles District Attorney George Gascón to help free the menedez brothers has contributed to quite a stir in his office.

His colleagues say the move is self-serving as he interferes in a huge case to raise his profile as he fights to keep his seat in the November election.

“There is no support for Gascón in the office,” a well-informed source in the district attorney’s office told The Post.

“Ninety percent of the people in the office think he should be fired. Everything he does is considered political or motivated by his own progressive agenda.

“It has been a disaster the way it has been implemented here. That’s why he in trouble in this election.”

Gascon, the former San Francisco district attorney from 2011 to 2019, has survived two impeachment attempts during his time in Los Angeles and is currently about 30 points behind rival Nathan Hochman in his re-election campaign.

“He is, and you can quote me, an out-of-touch idiot,” John Lewin, deputy district attorney with the Los Angeles County office, told The Post. “He doesn’t know anything about the law. He doesn’t know anything about the office. “He rarely shows up for work.”

Gascón, 70 years old, has drew a lot of attention since announcing it would review the case of Lyle and Erik Menendez, who were sentenced to life in prison for the 1989 double murder of their parents, earlier this month.

Critics have seized on the way he made the announcement just weeks after a new show and a hugely popular documentary about the brothers were released on Netflix.

“It’s a coincidence, that’s what he would say,” said John McKinney, a deputy prosecutor in the Los Angeles County District Attorney’s Office.

“Other people would say the stars don’t align like that in real life. Yes, the petition was filed in February. Yes, there was the movie. But (he) didn’t take action until after the movie?

The district attorney’s office told the Post: “The Los Angeles County District Attorney’s Office…conducts its public service work regardless of election cycles. “Our prosecutors are committed to working diligently and efficiently to manage the thousands of cases we receive annually.”

Inside the district attorney’s office – where some people who worked on the original case and the two trials against the brothers in 1993 and 1995 still work – two different camps were formed.

One faction feels the Menendezes should receive a minimized sentence and be set free, the other that they got what they deserved and should be given no mercy.

“A contingent strongly asked him not to do anything,” said a source who resented the sentence. “The other asked him to do more than he did.”

in a press conference last week Gascon requested a new sentence that would maintain the brothers’ first-degree murder charges but remove their non-parole status.

If a judge accepts their recommendation, it will open the door for the brothers to apply for parole and possibly be released.

Multiple sources interviewed by The Post agree that Gascón’s reason for seeking Lyle and Erik’s possible release is to increase his profile on the national stage, which has led him to appear on all national news networks multiple times.

Even if he has no chance of winning, according to McKinney, the Menendez case helps his campaign.

“I know Gascón’s campaign has little to no money,” said McKinney, who ran against Gascón in the primary for district attorney before “getting kicked out,” as he put it.

“They cannot publish ads on television, social networks or radio. And the only way to get exposure right now is to manufacture earned media.”

That said, there is also a belief that the resentencing attempt could backfire among its most ardent supporters. “I’ve heard rumors that far-left people think this is outrageous,” the source in the district attorney’s office said. “For example, how would you put these rich kids at the front of the line (for resentencing) when others probably deserve it more and have been waiting forever?”

Lewin is more cynical and believes the latest attention-grabbing case has more to do with sealing his legacy.

“My guess is that it’s actually about George Gascón’s career after district attorney. It will probably be like a George Soros scholar, an endowed professorship or whatever. And he will be introduced to adoring college law students as the godfather of progressive prosecution who died on the cross for the sins of the criminal justice system.

“He’s doing that with the resentence.”

Gascon has faced something of a revolt during his time in the Los Angeles district attorney’s office, which has left him with an inner circle of trusted appointees, and a host of other prosecutors who are distrustful, leading which leads to a sometimes strange work dynamic, sources have reported. he previously told The Post.

In the Menendez case, insiders said they were surprised that some of the veterans who had been involved in the Kyle and Erik case for years were not more involved.

“I think the people who knew every detail of the case should have been (consulted from the beginning,” the source said. “Gascón made his decision based on his interest. (The most informed staff) were consulted at the end. But that’s how it was. almost a fait accompli at that time.”

Taking it all in, McKinney said he’s not entirely surprised by how things have unfolded, with the request for a new trial and the resulting publicity.

“Most people feel this was politically motivated based on the timing,” he said. “People feel that it is typical of Gascón to do something like this.”
