Wife of Lakshadweep man who allegedly went missing from police custody petitions Kerala High Court for SIT probe

A plea has been filed with the Kerala High Court by the wife of a man who allegedly went missing while in police custody in Lakshadweep.

His wife, a permanent resident of Lakshadweep, has approached the court seeking setting up of a special investigation team headed by Superintendent of Police, Lakshadweep, to investigate the disappearance of her husband while in police custody.

Judge Bechu Kurian Thomas has requested instructions on the matter and published it on November 26.

According to the statement, there were some marital problems between the petitioner wife and her husband during which he slapped her. It was stated that upon hearing this noise, the neighbors informed the police and he was taken into police custody on October 9.

The plea alleged that on October 10, when the petitioner went to the police station, she was informed that her husband was taken to the hospital by the police as he was behaving like an abnormal man.

The plea stated that the petitioner and her family could not trace the whereabouts of her husband upon reaching the hospital. She also said that news was spreading on the island that her husband had disappeared at sea.

The petitioner claimed that the police did not reveal any details about her husband. She alleged that the block development officer prepared an incident report stating that her husband was abnormal and jumped into the sea while in police custody. She further claimed that authorities were trying to create false and fabricated accounts about her husband’s mental state.

The petitioner alleged that on November 12, the station house officer registered an FIR at Chetlat police station stating that the petitioner’s husband was missing. She stated that the police had intentionally omitted the fact that her husband had disappeared while in police custody.

Therefore, the petitioner seeks a fair and impartial investigation by a Special Investigation Team into the disappearance of her husband.

“It is evident that the petitioner’s husband was missing in police custody, but the police were hiding what exactly happened when he was in police custody. Now the same case is being investigated by the same culprits along with other police officers who were also present at the Chetlat police station at that time. The present investigation is biased, inadequate and unfair and therefore warrants the interference of this Honorable Court with immediate effect.” the petitioner submitted
