Dramatic Daniel Penny strangulation trial continues with first witnesses

More witnesses are expected to testify at Daniel Penny’s trial on Monday.

Pennya 26-year-old former Marine, is charged with second-degree murder and negligent homicide. He is accused of fatally choking Jordan Neely, 30, on the New York City subway in 2023. Neely, an acquaintance A Michael Jackson impersonator, he boarded the subway and reportedly began threatening people. Penny allegedly approached him from behind and strangled him.

Neely was later pronounced dead. in a hospital. His death was ruled a homicide due to neck compression.

Jury selection for the trial concluded Wednesday. Prosecutors and the defense gave their opening statements Friday.

Prosecutors argued that Penny “went too far” when she strangled Neely for six minutes.

“Jordan Neely breathed his last on the dirty floor of an uptown F train; at the time of his death he was 30 years old, homeless, using synthetic drugs and suffering from mental illness,” the prosecutor said. Manhattan District Deputy Dafna Yoran in her opening statement.

The defense argued that Penny was trying to protect other passengers from someone who was potentially dangerous.

“This is a case about a young man who did for others what we would like someone to do for us,” defense attorney Thomas Kenniff said in his opening statement. “Words like ‘I’m ready to die. I’m ready to serve a life sentence,’ when these threats are uttered in the confined (space) of a moving subway car, you either bury your head and pray or you stand up and protect your neighbor.” .That’s what Danny Penny did.”

Prosecutors called five witnesses to testify Friday, including three new york police officers. Jurors were also shown police body camera footage of the incident.

In the video, a police officer asks Penny what happened.

“I put it out,” Penny said.

Outside the courtroom, protesters held signs and called Penny a “subway strangler.” Chanting could be heard from inside the courtroom.

New York Supreme Court Judge Maxwell Wiley said he would ask jurors to ignore “the noise outside the courthouse.”

The trial is expected to last four to six weeks, according to Wiley.

If convicted, Penny faces up to 15 years in prison on the involuntary manslaughter charge and up to four years on the negligent homicide charge.
