Tiger Brands: Lawyers say no compensation has been agreed in listeriosis case

Tiger Brands says any relief offered to victims is not an admission of guilt.

Lawyers representing listeriosis victims in the Tiger Brands class action lawsuit say they have not agreed to any compensation for the victims’ medical expenses.

Tiger Brands included in its operating update Wednesday that it will pay medical expenses for some of the victims of the 2017 and 2018 listeriosis outbreaks.

However, its executive director said relief for victims is not an admission of guilt.

No compensation agreed with Tiger Brands

Attorneys for plaintiffs in the class action lawsuit, Richard Spoor Inc, say they are working with Tiger Brands attorneys to obtain relief for victims; However, there has been no compensation agreement and none of its clients have been compensated to date.

“According to its statement, Tiger Brands still denies liability to the victims of the outbreak and any agreement or discussion on interim measures is done ‘without prejudice’ and parallels the litigation process.”

Listeriosis: ongoing conversations about liability

Tiger Brands did not disclose how much it will pay the victims for their medical expenses.

According to its operational update, its attorneys are making pretrial preparations for the class action, which involves discovery of documents and records to prepare the matter for trial and for the court to determine liability.

Richard Spoor Inc said it is still working to prove Tiger Brand’s “responsibility” for the listeriosis cases.

“We remain confident that we will establish Tiger Brands’ liability to all victims of the outbreak and, as such, we continue our trial preparations to ensure justice for those who suffered harm as a result of consuming Tiger Brands’ contaminated listeria products. ”said Richard Spoor Inc.

Medical records

“In January 2023, the two lawyers approached the National Institute for Communicable Diseases (NICD) to obtain access to its records relevant to the listeriosis outbreak,” the Tiger Brands update reads.

These are considered vital when determining liability.

Earlier this year, the NICD provided plaintiffs’ attorneys with files containing some data related to its investigation of the listeriosis outbreak.

“The files were shared with the company’s lawyers in February 2024 for review by appointed experts. Expert review of the data is at an advanced stage but remains ongoing,” Tiger Brands said.
