Man sentenced to more than 12 years in prison for selling fentanyl to man who died of an overdose

A 25-year-old Davenport man has been sentenced to 12.5 years in prison for selling fentanyl to a man who died of an overdose.

During a sentencing hearing held Wednesday in U.S. District Court in Davenport, U.S. District Court Judge Rebecca Goodgame Ebinger sentenced Nathan Neil Tyson to 150 months in prison for distributing fentanyl causing death.

Ebinger also ordered Tyson to serve five years of supervised release after serving his prison sentence.

There is no parole in the federal prison system.

According to search warrants filed in the case by Davenport Police Detective Ryan Leabo, police were dispatched to a residence in the 2100 block of West 66th Street on July 17, 2021 at approximately 9:53 PM to investigate an unresponsive person.

Officers found 18-year-old Brady Delvichio in his basement bedroom. He was pronounced deceased by Davenport Fire Department paramedics.

An autopsy conducted on July 19, 2021 revealed that Delvichio died of acute drug intoxication (fentanyl).

A search of Delvichio’s phone revealed messages showing Tyson selling fentanyl-laced pills, “perc 30s,” to Delvichio.

Following an investigation, a federal grand jury indicted Tyson on May 9, 2023, on charges of conspiracy to distribute a controlled substance, fentanyl, and distribution of a controlled substance causing death.

During a change of plea hearing on July 24, 2024, Tyson pleaded guilty to the lesser offense of distribution of a controlled substance causing death.

In addition to his prison sentence, Tyson must pay $5,416.45 in restitution.

At the time of his 2023 arrest on federal charges, Tyson was on probation in Scott County for a class D felony charge of possession with intent to deliver marijuana. He had pleaded guilty to the marijuana trafficking charge during a hearing on May 6, 2022, in Scott County District Court. He was sentenced to two years’ probation in that case on July 7, 2022.
