Waco felon accused of sexual assault pleads guilty to reduced charge, released from jail

WACO, Texas (KWTX) – A three-time convicted felon accused of sexually assaulting the mother of his children in 2022 pleaded guilty Thursday to a lesser charge and was set to be released from prison.

Richard Dwayne Bogans, 56, of Waco, pleaded guilty to class A misdemeanor battery and family violence in a plea deal in Waco’s 54th State District Court in which prosecutors reduced the charge of second-degree sexual abuse and recommended a 200-day sentence. provincial jail.

Judge Susan Kelly accepted the plea deal and gave Bogans, who received up to 20 years in prison for sexual assault, credit for the 112 days he spent in the county jail. His attorney, Darren Obenoskey, said inmates at the county jail receive two days of credit for each day in jail, adding that Bogans will likely be released Thursday evening.

A jailer confirmed late Thursday afternoon that officials were processing Bogans’ release papers.

Bogans was accused in a sealed indictment in June 2023 of sexually assaulting a woman at her Proctor Avenue home in February 2022.

He was charged under seal because Waco police failed to arrest Bogans in the incident and sent the case to the McLennan County District Attorney’s Office for referral.

According to police records, Bogans and the woman had gotten into an argument. Bogans left the home but returned and sexually assaulted her, Waco police reported.

The woman told police she resisted the attack and told Bogans no, according to arrest records.

DNA evidence linking Bogans to the crime was confirmed through the Combined DNA Index System, a national DNA database, court records show.

Obenoskey said prosecutors agreed to reduce the charge and recommend a prison sentence because the woman changed her mind about reporting the assault and would not cooperate with the district attorney’s office.

Bogans was convicted of assault and forgery in Denton County and sentenced to six years in prison in 1991. In 1995 he was released on parole.

He was also sentenced in November 2004 to three years in prison in Leon County for possession of marijuana and was released on parole in December 2005, according to court records.
