Footy star learns his fate after illegally filming himself having sex with woman and giving her shocking three-word apology

South Sydney Rabbitohs junior Toby Sullivan has avoided a conviction after recording himself having sexual intercourse with a woman without her consent.

Sullivan, 21, was sentenced at Waverley Local Court on Tuesday after pleading guilty to intentionally recording an intimate image without consent.

Court documents show the offense occurred on December 16, 2023, when the talented Rabbitohs prospect was having a night out with friends at the Coogee Pavilion Hotel in Sydney’s east.

CCTV footage showed the young football star standing on the dance floor of the hotel with a 34-year-old woman.

The couple later went to an address in Bondi where they had consensual sex in the living room.

The pair soon moved on to the bedroom, where Sullivan recorded himself and the woman on his phone as she faced away from him.

Court documents show the woman grabbed his phone and deleted the recording when she realized what was happening.

“It’s just for the boys,” Sullivan explained, before trying to excuse his behavior by adding that he was “just a kid.”

Sullivan left the property shortly afterwards and the victim reported the incident to police the next day.

Sullivan was charged in March but initially denied doing anything wrong and even told police he was not at the Coogee Pavilion Hotel on the night in question.

Police later recovered the deleted files from Sullivan’s phone, along with a selfie he took while inside the woman’s home.

On Tuesday, Magistrate Michael Barko wondered why the young football star couldn’t “enjoy the sunset” without having to take a photo.

“Can’t you do anything without a cell phone?” he said.

“Can’t you enjoy a sunset, outside or even sexual intercourse?”

Mr Barko later added: ‘Some would argue that the defendant was even lucky to be there, let alone share it with his comrades.’

Mr Barko imposed an 18-month conditional release order on Sullivan.
