Jay Cutler arrested on charges of driving under the influence and possession of a gun while intoxicated

The retired NFL quarterback was arrested Thursday evening in Franklin, Tennessee, and released on $5,000 bail, PEOPLE confirms

Former NFL quarterback Jay Cutler was arrested Thursday evening in downtown Franklin, Tennessee, and is charged with driving under the influence and illegal possession of a weapon, along with two other charges, after police say he rear-ended another vehicle, PEOPLE confirms.

Cutler, 41, was arrested and later released on bail Thursday evening, a Franklin Police spokesperson tells PEOPLE.

The former NFL star is charged with DUI (first offense), possession of a handgun while intoxicated, implied consent and failure to exercise due care to avoid a collision, Franklin police official says.

In a news release shared later Friday morning, the Franklin Police Department said officers responded to a “minor traffic collision in downtown Franklin” Thursday evening shortly after 5 p.m. local time.

The department says evidence at the scene shows Cutler “struck another vehicle from behind” and that officers who spoke to the former NFL star at the scene “detected a strong odor of alcohol” on him.

“Cutler also slurred his words and had bloodshot eyes,” Franklin police said. “Cutler refused field sobriety tests and was taken to a local hospital where a blood sample was obtained through a blood test.”

Franklin police officers then found “two firearms in his vehicle, including a loaded handgun,” the department says.

Cutler was released Thursday evening on $5,000 bond.

The retired quarterback was drafted into the NFL in 2006 and played 12 seasons in the league with the Chicago Bears, Miami Dolphins and Denver Broncos.

Cutler married reality TV star Kristin Cavallari in 2013 and they have three children together: sons Camden, 11, Jaxon, 9, and daughter Saylor, 8.

The couple, who first met in 2010 before getting engaged a year later, divorced in 2020, citing “irreconcilable differences” and “inappropriate marital behavior” as reasons for their breakup.

In their divorce filing, Cavallari alleged that Cutler was “guilty of such inappropriate marital conduct as to render further cohabitation unsafe and inappropriate” and said that “any misconduct alleged or implied against her” in Cutler’s divorce petition was “in response to and/or as a result thereof of misconduct on (Cutler’s) behalf.”

Cavallari, who played the lead role Laguna Beach star, then started dating 24-year-old TikToker, Mark Estes, before ending the relationship earlier this year.

Earlier this month, Cavallari said her custody agreement with Cutler had changed.

“When I was dating last fall, I still had shared custody with my ex and had every other week off from my kids and that has changed,” she said during an episode of her podcast Let’s be honestalthough she did not clarify the changes to their agreement.
