Georgia Court of Appeals Rules in Favor of Bainbridge Monkey Facility Company

BAINBRIDGE, Ga. (WALB) – After months of back-and-forth legal battles, the Georgia Court of Appeals ruled in favor of Safer Human Medicine (SHM), the company behind the monkey facility being installed in Bainbridge.

In June, Decatur County District Attorney Joe Mulholland raised concerns about the legality of the project with the Court of Appeals. In a legal brief filed by Mulholland, he said the trial court should be reversed and the Validation Order should be vacated in the project.

SHM has continued to argue that the project was properly approved by city and county officials.

In the new ruling from the Court of Appeals, they said they ruled in favor of Safer Human Medicine “Because the State asked the trial court to validate the bond, it cannot file an appeal against the trial court’s order that grant that request.”

They also noted “…at the appellate level one cannot complain about a ruling, order or ruling that one’s own procedure or conduct brought about or helped cause. The trial court granted the State’s request to validate the bonds in question. Therefore, the trial court’s order provides no basis for the State to appeal and this appeal must be dismissed.”

Safer Human Medicine issued this statement following the ruling:

WALB has reached out to Mulholland and is waiting to hear back. In previous interviews, Mulholland told WALB that if the courts ruled in favor of SHM, he would take the matter to the Supreme Court.
