Alvarez was indicted by Superior Court grand jury on May 21 and was processed on May 31. Brockton Superior Court Judge Mary Sullivan, who set bail, said at the time that $500 was a significant amount for someone with no income.

He has been held at the Plymouth County Correctional Facility since then, but has been in court for his court dates, except for one on August 13, the day he was first detained.

The district attorney’s office said ICE notified them of his deportation plans on Oct. 4, which, in turn, led to the filing of the bail increase motion.

“(Without) a bail increase, the defendant, an alleged citizen of Haiti here in the United States pursuant to the United States Immigration’s Cuba, Haiti, Nicaragua and Venezuela Parole Program, is scheduled to be expelled from the United States on October 31, 2024, leaving him unable to respond to the accusations against him. Such a scenario would paralyze the case indefinitely, preventing any resolution for both the alleged victim and the accused,” the file reads in part. .

After an hour-long hearing Oct. 28 in Brockton Superior Court, Judge Elaine M. Buckley agreed with prosecutors. The $150,000 bail she set far exceeded the state’s request that Alvarez be held on $100,000 with conditions.

“The commonwealth has strong motives,” Buckley said during the hearing. “The court finds that justice requires an increase in bail.”

Alvarez is scheduled to appear in court on Nov. 13 for a discovery status hearing.
