Family of unarmed man shot and killed by Prescott police plans to file charges

PRESCOTT, AZ (AZFamily) – We’re hearing for the first time from the family of a man shot by police in Prescott and they plan to file a lawsuit against the department.

Detectives say 34-year-old Daniel Leslie threatened his girlfriend the day before and was unarmed when officers opened fire on June 8 to stop him from entering his home.

His family has filed a claim, a precursor to a lawsuit, against the officer, the department and the city.

Leslie’s mother, Wendy Leslie, was just feet away when that deadly encounter unfolded and told the Arizona family she wanted to charge the officer with manslaughter.

The body camera video released last week shows the officer at the front of the house approaching Daniel, who is standing outside.

The officer shouts, “Come here!”

He then asks Daniel’s mother, “Ma’am, is there anyone in that house?”

She responds that it is, and the officer is then heard saying, “Don’t go in there; you will be shot.”

It appears the officer starts shooting mid-sentence as Daniel enters the house. Three shots were heard.

Wendy said the fatal shooting is a moment she has been reliving since June.

“My doctor diagnosed me with PTSD. It’s the reason I left my home of 34 years. “I couldn’t walk into my kitchen and make a cup of coffee without seeing his blood on the floor, even though it took a long time to clean up,” she said.

She is seen in the officer’s bodycam video saying that day changed her life forever.

“I never thought he would be shot for no reason,” she said emotionally. “It never crossed my mind until the bullets came out of that gun.”

Prescott police responded to reports that Daniel threatened his girlfriend and tried to break down the door of an RV where she was staying.

“A lot of this came down to the way she acted and the activities she did in front of the child that Daniel cared deeply about. Its entire existence was to protect these children and the child and to reduce trauma for the child,” Wendy said.

According to police, Daniel initially ran from the scene on June 7 and was later spotted by an officer attempting a traffic stop, but Daniel sped away.

The next day, officers returned to the house and he was shot and killed.

Richard Lyons, who is representing the family, believes Daniel was within his legal rights to refuse to speak to the officer.

“Daniel says, ‘No, I’m not going to talk to you.’ He is exercising his Fifth Amendment privilege not to talk to police,” Lyons said.

He watched the bodycam video for the first time with Arizona’s Family and said he was shocked by what he saw.

“The officer says, ‘I want you to get out of the car.’ Daniel does so and the officer pulls his gun anyway. I have no idea why he’s drawing on him. There is no weapon. At that moment he is not doing anything wrong. He pulls a minibike out of a car,” Lyons said.

The video shows the interaction between Daniel and the officer quickly escalating.

“It went from 0 to 100 in an instant and if you listen to the bodycam he says, ‘I’m trying to make contact.’ He doesn’t say on his radio, ‘I’m going to arrest this guy,'” Lyons clarified.
