Today (21st), Judge Choi Young of the Civil Division 3 of the Busan District Court announced that he has confirmed the plaintiff’s victory in a lawsuit filed by the victim against the perpetrator Lee for damages of 100 million won.

During the course of the trial, the court found that defendant Lee had admitted the plaintiff’s claim because he had never been to court and provided no advice, and cited all of the plaintiff’s claims.

Lee appealed this, but was ordered to dismiss the complaint because he had failed to pay the stamp and service fees required for the appeal. Within 14 days of the decision to dismiss the letter of appeal being made, the appeal notice and service fees were not paid or the appeal was not resubmitted, and no immediate appeal against the decision to dismiss was made.

However, due to the nature of civil lawsuits, actual seizure or execution may not be straightforward if the defendant’s property is not present even in the final judgment of damages.

Lee was accused of trying to beat the victim to death in the common hall of the office after chasing him for about 10 minutes with the aim of sexually assaulting the victim who was returning from Seomyeon, Busanjin- gu, and the Supreme Court upheld a twenty-year prison sentence. Later, Lee’s attempted murder charge, which was applied in the first trial, was changed to attempted rape and murder during the appeal trial.
