The firing of an employee by Phosphate Resources for ‘sucking up to the boss’ was ruled unjust

A miner who was dismissed for repeatedly insulting his colleague with insulting comments was unfairly dismissed because he had not been properly trained in the new psychosocial safety policy, a tribunal has ruled.

The Fair Work Commission found that an experienced truck driver at Phosphates Resources’ Christmas Island mine was rightly dismissed for bullying, including joking about ‘sucking the boss’s cock’ and then humiliating his colleague when he was ordered to stop.
