Driver in fatal 2022 East China Township crash gets jail time

A man found guilty of a fatal crash in 2022 was sentenced to prison on October 7.

Joshua Collier, 34, was ordered to serve between seven and 15 years in prison for driving a vehicle while intoxicated causing death. He was also sentenced to 39 months to five years in prison for operating a vehicle while intoxicated causing injury, to be served concurrently. Collier was given credit for having already served two years.

A jury found Collier guilty after a trial in August, ruling that he did not meet the requirements to be declared legally insane despite his diagnosis of schizophrenia.

Collier admitted to police that he was high on nitrous oxide before running a stop sign at the intersection of Wadhams and Puttygut roads and hitting the victims’ vehicle. According to the National Institute of Health, nitrous oxide is known to cause dizziness, disassociation, disorientation, loss of balance, weakness in the legs and impaired cognition.

At the sentencing, St. Clair County Assistant Chief Public Defender Frederick Lepley asked for leniency, saying Collier needed help dealing with his mental illness.

“Mr. Collier has struggled with significant mental health issues,” Lepley said.

However, Assistant St. Clair County Prosecutor Paul Soderberg reiterated his argument from the conclusion of the trial, saying Collier could not explain his actions two years ago due to mental illness.

“Schizophrenia is not the cause of this crash,” Soderberg said. “He knew nitrous would affect him.”

Relatives of the victims also spoke during Collier’s sentencing, saying he should serve a lengthy prison sentence for the damage and death he caused.

Circuit Court Judge Cynthia Lane gave Collier a chance to speak during his sentencing. He brought up the problems he was having with his care in prison, but Lane told him she did not run the prison and would not address these problems. After some back and forth discussion with the judge, Collier decided not to make a statement.
