Fall Festival attendee accused of assaulting a child waiting in line for a ride

HENDERSON, Ky. (WEHT) – An Evansville woman is in custody after police say she grabbed a minor by the throat during the West Side Nut Club Fall Festival.

Police say they saw a 12-year-old juvenile approach Kristin Burnett in a non-threatening manner before Burnett allegedly grabbed her by the throat and “forcefully pushed her against the fence of an amusement ride.”

Another person in the altercation, Michael Flemming, allegedly grabbed Burnett and didn’t let go so detectives could arrest her.

Police say the younger heard people behind her yelling about someone possibly cutting the line, and she apparently tried to offer Burnett her place in line to de-escalate the argument. However, the youth did not think Burnett heard her and says Burnett attacked her when she approached her.

Burnett was charged with battery, strangulation and disorderly conduct.

Flemming was charged with battery, resisting law enforcement and disorderly conduct.

Both were booked into the Vanderburgh County Jail.
